A priest of the UOC in Volyn and his family were evicted by Court decision at the suit of the Kyiv Patriarchate

April 5, 2016. A priest of the UOC in Ugrinov village of Gorokhov region, Rostislav Sapojnik and his wife Natalia Sapojnik were evicted from the house where they had been living for 18 years, by the decision rendered by Lokachi Regional Court at the suit of the Kyiv Patriarchate, which has subsequently privatized the domicile, as the website Union of the Orthodox Journalist reports.

Moreover, the Court stated that their children, the first year university student Dionisiy and the school student Kirill reserve the right to reside at the said address.

According to the archpriest Rostislav Sapojnik, the representatives of the Service for Juvenile Matters of Gorokhov region were absent at the hearing having explained that they refer the consideration of the case concerning the eviction of the juveniles ‘to the court’. The juveniles weren’t evicted indeed, but it appears that their parents have to provide a remote parental care, being evicted from the house, were the whole family was registered at the moment of its privatization by the Kyiv Patriarchate.

Let us recall that the community of the Kyiv Patriarchate was registered in Ugrinov village after the capture of the UOC church in November 2014. Nevertheless, the intruders claimed their rights to the house where the priest continued to live together with his family. They do not have another domicile.

Though the consideration of the case concerning the question of ownership of the house land is still pending, in summer 2015 the Kyiv Patriarchate was granted the property right over this house. In Autumn intruders filed a case to evict the family residing at this address.

The decision of the Lokachi Regional Court will be contested in the Court of Appeal. And we can just guess how the enforcement officers will execute it in case the decision remains unchanged.
